1. Introduction and Acceptance
These Terms and Conditions ("Terms") govern your use of the ZwipKart website and mobile application, and your purchase of goods through our platform. By accessing ZwipKart, browsing products, or placing an order, you agree to be legally bound by these Terms.
If you do not agree with any part of these Terms, please do not use ZwipKart or make purchases.
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last Modified" date. Your continued use indicates acceptance of the revised Terms.

3. The ZwipKart Marketplace
ZwipKart is a digital marketplace that connects buyers with sellers of refurbished and second-hand technology and smart devices. This is not a store owned and operated solely by ZwipKart Ltd. Rather:
- ZwipKart Ltd may sell products directly as a merchant
- Third-party Sellers (independent merchants) list and sell products through the marketplace
- ZwipKart facilitates all transactions, handles payments, provides Buyer Protection, and manages customer service
When you purchase from a third-party Seller, the Seller is responsible for product accuracy, condition, and delivery. However, ZwipKart guarantees your rights as a buyer through our Buyer Protection programme.
ZwipKart Assurance
All Assured sellers on ZwipKart provide:
- 30-day hassle-free returns and full refunds
- 12-month ZwipKart warranty on all devices
- IMEI verification on all phones
- Secure, encrypted payment processing
4. Eligibility
By using ZwipKart, you confirm that:
- You are at least 18 years old (or have parental/guardian consent)
- You are a legal resident of the United Kingdom
- You have the authority to enter into legal agreements
- You will use ZwipKart for lawful purposes only
- You will not resell goods on ZwipKart without authorisation
5. Orders and Contract Formation
How Orders Work
- You browse products and select an item
- You add the item to your cart and proceed to checkout
- You provide shipping and billing information
- You review your order and submit it
- Your order is an offer to purchase — it is not yet a binding contract
- We review your order for accuracy, stock availability, and payment verification
- When you receive an order confirmation email, the contract is formed
- We arrange payment processing and dispatch your order
Order Acceptance and Cancellation
ZwipKart reserves the right to:
- Accept or decline any order at our discretion
- Cancel orders if items are out of stock
- Cancel orders if information is incorrect or fraudulent
- Cancel orders if payment cannot be verified
- Cancel orders if prices appear to be errors
If we cancel your order, we will refund any payment within 5-10 business days and notify you of the reason.
Your Right to Cancel
Once an order is confirmed, you may cancel within 14 days of delivery under the Consumer Contracts Regulations 2013 (cooling-off period). Items must be returned in the condition received. See our Returns Policy for details.
6. Pricing and Payment
Pricing
- All prices are in GBP and include VAT at the current rate (20%)
- Prices are subject to change without notice, but prices at the time of order confirmation are guaranteed
- Delivery charges are displayed at checkout (standard delivery free on orders over £299)
- We accept no responsibility for price errors — we will contact you if a price is clearly incorrect
Payment Methods
We accept the following payment methods:
- Visa, Mastercard, and American Express (credit and debit cards)
- PayPal
- Klarna (buy now, pay later)
- Clearpay (buy now, pay later)
Payment Security
All payments are processed securely through Stripe, a PCI-DSS Level 1 compliant payment processor. We do not store full credit card numbers on our servers. Card details are encrypted and transmitted securely.
Payment Authorisation
By submitting your payment, you authorise us to:
- Charge your payment method for the full order amount (including VAT and delivery)
- Perform identity and fraud checks
- Verify your card with your bank or payment provider
Failed Payments
If your payment fails:
- We will notify you via email
- Your order remains in a "pending" state for 24 hours
- You must resubmit payment or your order will be cancelled
- If cancelled, you may re-place your order
7. Delivery and Risk of Loss
Delivery Areas
- Mainland UK: Standard and next-day delivery available
- Northern Ireland, Scottish Highlands, Islands: Standard delivery available; additional charges may apply
- We deliver Monday to Friday (excluding bank holidays)
Delivery Timescales
- Standard Delivery: 1-3 working days (FREE on orders over £299)
- Next-Day Delivery: Available if ordered before 3pm Monday-Thursday (£9.99, FREE on orders over £299)
Order Tracking
Once your order is dispatched, you will receive:
- Dispatch confirmation email with tracking information
- Courier tracking link (Royal Mail, DPD, or similar)
- Text alerts (if you provided your mobile number)
Delivery Attempts
If delivery is attempted and no one is home:
- The carrier will leave a card with re-delivery or collection information
- You must re-arrange delivery or collect from a local depot
- We are not responsible for additional delivery charges if re-delivery is required
Risk of Loss
- Before delivery: ZwipKart retains risk of loss. We are insured against damage or loss in transit.
- Upon delivery: Risk of loss passes to you once the item is delivered to your address
- Damage in transit: If items arrive damaged, contact us within 24 hours with photos. We will arrange replacement or refund.
Undeliverable Addresses
If your address is undeliverable or you do not collect the item from the depot within 7 days, we may:
- Return the item to stock and issue a refund (minus return shipping if applicable)
- Contact you to arrange re-delivery
8. Returns, Refunds & Cancellation Rights
Your Right to Cancel (Consumer Contracts Regulations 2013)
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods, without giving any reason. To exercise this right, contact us at support@zwipkart.com or call 07450 870864 with your order reference. You must return the goods within 14 days of notifying us. We will refund the full purchase price (including standard delivery costs) within 14 days of receiving the returned goods or proof of return postage.
Your Statutory Rights
Under the Consumer Rights Act 2015, you have the right to:
- Reject faulty or misdescribed goods within 30 days of delivery for a full refund
- Cancel within 14 days of delivery (cooling-off period) without giving a reason, subject to the condition that goods are returned in the same condition as received
ZwipKart's 30-Day Return Guarantee
We offer a 30-day return window on all items:
- Returns are free for all items (we provide a prepaid returns label)
- Items must be in the condition received (unused, with original packaging and accessories)
- Refunds are issued within 5-10 business days of us receiving the returned item
- No questions asked — we offer hassle-free returns
How to Return an Item

- We will send you a prepaid returns label by email
- Pack the item securely and drop it at a Royal Mail or courier location
- We will process your refund once we receive and inspect the item
Note: We do not accept returns via standard post. You must use the prepaid label provided.
Items Not Eligible for Return
- Items damaged due to customer misuse, drops, spills, or impact
- Items with missing components or accessories that were included with the original order
- Items returned after 30 days (unless faulty — see warranty section)
Faulty or Damaged Items
If your item arrives damaged or develops a fault within the return window:
- Contact us immediately with photos of the damage/fault
- We will arrange free collection and either replace the item or issue a full refund
- We will send a replacement or refund within 5-10 business days
9. Warranty and Assurance
ZwipKart 12-Month Warranty
Every product sold by ZwipKart (or through Assured sellers) comes with a comprehensive 12-month warranty from the date of purchase. This covers:
- All mechanical and electrical faults during normal use
- Component failures not caused by misuse
- All labour and replacement parts costs
- Free collection and redelivery for repairs
What's Not Covered
- Accidental damage (drops, spills, impact)
- Damage caused by improper use or neglect
- Cosmetic damage that does not affect functionality
- Normal wear and tear
- Damage from non-authorised repairs
How to Make a Warranty Claim
- Contact us at support@zwipkart.com with your order reference and description of the fault
- Provide photos of the issue if possible
- We will assess your claim and arrange collection if necessary
- We will repair or replace the item free of charge
- We will redelivery the item at no cost
Response time: We aim to respond to warranty claims within 48 hours.
Extended Warranty
We offer optional extended warranty coverage:
- 2-Year Cover: 12 additional months of coverage (from £49)
- 3-Year Cover: 24 additional months of coverage (from £89)
Extended warranty covers the same faults as the standard 12-month warranty and can be purchased at checkout or within 14 days of delivery.
10. Intellectual Property Rights
ZwipKart Content
All content on the ZwipKart website and application, including text, images, graphics, logos, product descriptions, and code, is the property of ZwipKart Ltd or licensed to ZwipKart. This includes:
- ZwipKart trademarks, logos, and brand identity
- Website design and layout
- Original product photographs and descriptions
- Proprietary software and technology
Your Limited License
You are granted a limited, non-exclusive, revocable license to:
- Access and view ZwipKart content for personal use
- Download content for personal, non-commercial purposes only
You may NOT:
- Reproduce, distribute, or republish ZwipKart content without permission
- Scrape or automated access the website
- Use ZwipKart content for commercial purposes
- Modify or create derivative works
- Remove copyright, trademark, or other proprietary notices
User Content
By posting reviews, ratings, or other content on ZwipKart, you:
- Grant ZwipKart a non-exclusive, worldwide license to use your content
- Represent that you own or have rights to the content
- Warrant that the content does not infringe third-party rights
ZwipKart may remove any content that is defamatory, infringing, or violates these Terms.
11. Prohibited Conduct
You agree not to:
- Use ZwipKart for illegal purposes or in violation of any laws
- Provide false, misleading, or fraudulent information
- Engage in fraud, hacking, or unauthorised access
- Upload viruses, malware, or other harmful code
- Harass, abuse, or threaten other users or staff
- Spam, flood, or interfere with website functionality
- Circumvent security measures or access restricted areas
- Resell items purchased on ZwipKart without authorisation
- Create multiple accounts to evade restrictions
Violation of these terms may result in account suspension or termination.
12. Limitation of Liability
To the Maximum Extent Permitted by Law
- Our total liability shall not exceed the price of the goods purchased in the order giving rise to the claim
- ZwipKart is not liable for indirect, incidental, consequential, or punitive damages
- This includes loss of profits, data, business opportunity, or reputational harm
Exceptions (Liability We Cannot Exclude)
Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Breach of statutory rights (consumer protection laws)
- Any liability that cannot be excluded by law
Third-Party Services
ZwipKart is not responsible for:
- Website downtime or technical failures beyond our control
- Third-party seller conduct (except where we guarantee buyer protection)
- Loss of data due to circumstances beyond our control
- Courier/carrier failures (though we manage carrier liability)
13. Indemnification
You agree to indemnify and hold harmless ZwipKart Ltd from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of ZwipKart in violation of these Terms
- Your violation of any applicable law or regulation
- Your infringement of any third-party rights
- Content you post or transmit via ZwipKart
- Your disputes with other users or sellers

- Consumers in Scotland or Northern Ireland may also bring proceedings in their home courts
- You agree to submit to the exclusive jurisdiction of the English courts
Consumer Rights
If you are a consumer in the EU or EEA, you may have additional rights under your local consumer protection laws. Nothing in these Terms affects your statutory rights as a consumer.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid:

- If modification is not possible, that provision will be severed
- All other provisions remain in full force and effect
17. Entire Agreement
These Terms and Conditions constitute the entire agreement between you and ZwipKart regarding your use of the website and purchases of goods. These Terms supersede any previous agreements, understandings, or representations.
Our Privacy Policy and other policies (Shipping, Returns, Warranty, Cookie Policy) are incorporated by reference and form part of these Terms.

16. WEEE & Battery Disposal
The Waste Electrical and Electronic Equipment (WEEE) Regulations 2013 require that old electrical equipment is collected separately for proper recycling and disposal.
What This Means for You
When you purchase a new or refurbished electronic product from ZwipKart, you have the right to have your old equivalent product collected free of charge on a like-for-like, one-for-one basis. The crossed-out wheelie bin symbol on electrical equipment means it should not be disposed of with household waste.
How to Recycle
- Local recycling centres: Take old electronics to your nearest household waste recycling centre. Visit recyclenow.com to find your nearest centre.
- Retailer take-back: Contact us at support@zwipkart.com for guidance on returning old equipment when purchasing a replacement.
- Batteries: Portable batteries and accumulators should be removed (where possible) and recycled separately at designated collection points, available at most supermarkets and retail stores.
Our Responsibilities
ZwipKart is committed to meeting our obligations under the WEEE Regulations. We are registered as a distributor of electrical and electronic equipment and work with approved compliance schemes to ensure responsible collection and treatment of WEEE.
